1. Agreement

These Terms of Service ('Terms') govern your use of the Digital Secrets website at digitalsecrets.com.au and the purchase of services provided by Digital Secrets, a digital agency based in Melbourne, Victoria, Australia. By accessing our website or placing an order, you agree to be bound by these Terms.

2. Services

Digital Secrets provides website design, web development, branding, digital marketing, and SEO services. Our flagship 'Website in 48 Hours' product delivers a professional business website within 48 hours (Standard) or 24 hours (Express) of order confirmation.

All features included in each package are as described on our Website in 48 Hours page at the time of purchase.

3. Pricing & Payment

• All prices are in Australian Dollars (AUD) and include GST where applicable.
• Payment is processed securely via Stripe at the time of ordering.
• We accept major credit and debit cards.
• After year 1, domain and hosting renewal is $279 AUD/year. We will notify you 30 days before renewal.
• We reserve the right to update pricing. Any price changes will not affect existing orders.

4. Delivery

• Delivery timelines begin once payment is confirmed and your order brief is complete.
• Standard delivery is within 48 hours. Express delivery is within 24 hours.
• If we miss the express delivery deadline, we will refund the express upcharge ($199 AUD).
• The 48-hour delivery guarantee applies to the initial website preview, not the final live launch.

5. Revisions & Changes

• You receive up to 30 changes within the first 3 months at no extra cost.
• Changes include text updates, image swaps, colour adjustments, and minor layout tweaks.
• After 3 months, additional changes are $250 AUD per 10 changes.
• Structural redesigns, additional pages, or new features are quoted separately.

6. Intellectual Property

Upon full payment, you own the content and design of your website. Digital Secrets retains the right to display your website in our portfolio unless you request otherwise in writing. You warrant that any content or images you provide do not infringe third-party rights.

7. Refunds

Due to the nature of our service, refunds are not available once work has commenced (i.e., after we have begun designing your website). If we are unable to deliver your website, a full refund will be provided. If you have concerns about your completed website, please contact us and we will work to resolve them using your included revisions.

8. Limitation of Liability

To the maximum extent permitted by Australian law, Digital Secrets is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability to you shall not exceed the amount paid for your order.

9. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
